These Terms of Use govern your access to and use of Tech Rakshak SmartCampus ERP, a software platform developed by Tech Rakshak for schools, colleges, institutes, and coaching centers to manage daily operations digitally. By accessing, registering for, or using the platform, you agree to comply with and be bound by these Terms of Use.
1. Services Offered
Tech Rakshak SmartCampus ERP provides institute and coaching management software services, including but not limited to:
- Student registration and admission management
- Face camera attendance and attendance tracking
- Fees collection, dues tracking, and payment records
- Class, batch, and timetable management
- Exam scheduling, marks entry, and result management
- Staff and teacher management
- Parent and student portal access
- Notifications, announcements, and communication tools
- Reports, analytics, and dashboard-based monitoring
- Other custom ERP modules developed by Tech Rakshak
2. User Accounts and Eligibility
To use SmartCampus ERP, users may be required to create an account or receive login credentials from their institution. By using the platform, you agree that:
- You will provide accurate and complete information.
- You are responsible for maintaining the confidentiality of your login credentials.
- You will not share your username, password, or account access with unauthorized persons.
- Institutions are responsible for managing access for their students, staff, and administrators.
3. User Responsibilities
By using Tech Rakshak SmartCampus ERP, you agree to:
- Use the platform only for lawful and authorized purposes.
- Ensure that data entered into the system is accurate and not misleading.
- Not attempt to disrupt, damage, reverse engineer, or gain unauthorized access to the platform or server.
- Not misuse attendance, fees, student records, staff data, or exam-related information.
- Follow all applicable institutional, legal, and data protection requirements.
4. Subscription, Payments and Billing
Access to certain SmartCampus ERP services may be subject to subscription fees, onboarding charges, customization charges, or annual maintenance plans. By subscribing to our services:
- All fees must be paid as per the agreed invoice or contract.
- Delayed or non-payment may result in suspension of services or restricted platform access.
- Any custom development, branding, or additional modules may be billed separately.
- Taxes, if applicable, shall be payable by the client/institution.
5. Refund and Cancellation Policy
Refunds, if any, shall be governed by the commercial agreement between Tech Rakshak and the client institution. In the absence of a separate written agreement, software subscription fees, setup fees, customization charges, and implementation charges are generally non-refundable once the service has been activated, delivered, or implementation has started.
6. Data, Privacy and Security
Tech Rakshak SmartCampus ERP may process data such as student records, attendance logs, fees records, staff details, and academic information for software functionality. By using the platform, users and institutions acknowledge that:
- Data submitted to the platform should be lawful, accurate, and authorized by the institution.
- Tech Rakshak will take reasonable steps to protect platform data and maintain service security.
- Institutions remain responsible for obtaining necessary consent from students, parents, staff, or users wherever required.
- Use of the platform is also subject to the applicable Privacy Policy.
7. Intellectual Property Rights
All rights, title, and interest in Tech Rakshak SmartCampus ERP, including its software, design, source code, UI, dashboards, content, branding, modules, graphics, and documentation, remain the exclusive property of Tech Rakshak unless otherwise agreed in writing. Users and institutions may not copy, resell, distribute, modify, reverse engineer, or commercially exploit the software without prior written permission.
8. Platform Availability and Maintenance
We aim to keep the platform secure, stable, and available. However, Tech Rakshak does not guarantee uninterrupted or error-free service at all times. Scheduled maintenance, upgrades, server downtime, internet issues, or third-party service interruptions may temporarily affect access to SmartCampus ERP.
9. Limitation of Liability
To the maximum extent permitted by law, Tech Rakshak shall not be liable for any indirect, incidental, special, consequential, or business losses arising out of or related to the use or inability to use SmartCampus ERP, including data loss, service interruption, delayed communication, incorrect data entry by users, or decisions made based on platform-generated reports.
10. Suspension or Termination
Tech Rakshak may suspend or terminate access to SmartCampus ERP if:
- There is a breach of these Terms of Use.
- Payment obligations are not fulfilled.
- The platform is used for fraudulent, illegal, abusive, or unauthorized purposes.
- Required technical, legal, or security actions make suspension necessary.
11. Changes to These Terms
Tech Rakshak reserves the right to update or modify these Terms of Use at any time. Updated terms may be posted on the website, client dashboard, or shared through official communication channels. Continued use of the platform after such updates constitutes acceptance of the revised terms.
12. Governing Law
These Terms of Use shall be governed by and interpreted in accordance with the laws of India. Any disputes arising in connection with the use of Tech Rakshak SmartCampus ERP shall be subject to the jurisdiction of the competent courts applicable to Tech Rakshak’s registered business location.
